Ordering and privacy rules


Rules for ordering takeaway food and drinks on cafemontmartre.lt:
These Rules for ordering food and beverages for takeaway on cafemontmartre.lt ("the Rules") are a binding legal document for the Buyer and the Seller, which sets out the rights and obligations of the Buyer and the Seller and the conditions for the collection of the food and beverages and for the payment. Where the Buyer ticks the box "I have read and accept the Terms and Conditions" when placing an order for food and beverages, the Buyer shall be deemed to have acknowledged that he has read and agrees to be bound by the Terms and Conditions. The Terms and Conditions shall apply in the case of takeaway food and beverage orders placed on the cafemontmartre.lt website.


The seller of food and beverages is Kitokia Virtuve UAB (code 302351499 in the Register of Legal Entities), Didžioji st. 40, Vilnius. The Buyer confirms and understands that the Seller is the manufacturer of the food of his choice, from whose menu the Buyer chooses to order the respective products/items via the cafemontmartre.lt website.


Takeaway food and beverage orders accepted on the cafemontmartre.lt website ("Food and Beverage Order") shall be issued in Vilnius.
Food and drink ordering conditions:
(a) There is no minimum order amount for food and beverages.
(b) The production time for a food and beverage order shall be 40 minutes from the time of order confirmation, provided that the order does not exceed three courses. For larger orders, the staff shall inform the production time separately.
(c) Upon confirmation of the order, the customer will collect the order himself.
(d) Orders may only be cancelled by calling the unit directly on the telephone numbers indicated on the website www.cafemontmartre.lt at the latest 3 minutes after the order has been placed.
The final price is quoted once the Buyer's basket has been confirmed.

Payment methods for food and beverage orders may include:
(a) cash at the time of order pick-up;
b) by bank card (Visa, Visa Electron, Maestro, MasterCard) at the time of order collection.
The Buyer is fully responsible for the accuracy of the data provided and confirmed by him/her at the time of ordering the food and beverages and for ensuring that the order is collected at the time indicated. The Seller shall not be liable for the consequences and shall be entitled to claim damages from the Buyer in the event that the Buyer fails to provide accurate or incorrect data or confirmation of such data, or if the Buyer fails to take back the food and beverages ordered.
The Buyer shall be entitled to place an order for food and beverages solely in his own interest or in the interest of other persons (by delegation or authorisation). The Buyer shall only use, indicate and provide his/her own personal data or the data of persons who have given him/her such authority.
By submitting information and data to the Seller, the Buyer confirms that he/she is the owner (subject) of the personal data submitted or the person entitled to submit such data on a lawful basis.
The Buyer shall, by providing any information and data, ensure and be responsible for ensuring that the data (including but not limited to personal data) and information provided by it is true, accurate and complete.
The Buyer must familiarise itself with the Seller's approved and publicly available Privacy Policy. The Buyer shall express his/her consent or disagreement with the specific uses of the Buyer's Personal Data in accordance with the procedures set out in the Privacy Policy itself.
The Seller undertakes to respect the Buyer's privacy. The Buyer's Personal Data shall be processed only in accordance with the procedures set out in the Rules, the Privacy Policy and the legislation of the Republic of Lithuania.
The food ordered and the food prepared for the Buyer may differ externally from the pictures of the dishes in the menu on cafemontmartre.lt due to the specifics of the food packaging and containers.


The Buyer shall have no claim against the Seller and the Seller shall not be liable to the Buyer:
(a) if the Buyer has incorrectly stated the address for collection of the food and drinks ordered;
(b) if the Buyer has incorrectly provided his telephone number;
(c) if the Buyer misunderstands the time of production of the food and beverages ordered;
d) if the Buyer did not collect the ordered food and beverages through no fault of the Seller (failure to arrive for collection, failure to answer a telephone call, etc.);
e) if the Buyer fails or refuses to pay the Seller for the food and beverages ordered without objective reasons;
f) due to technical failures, malfunctions and other interruptions of the cafemontmartre.lt website;
(g) malfunctions, disruptions and other interruptions in the bank's payment card processing system.
The Seller shall have the right not to deliver the ordered food and beverages to the Buyer if any of the conditions referred to in Clause 16 of the Regulations exist.

The Buyer must check the order at the time of collection at the Restaurant and record any complaints or discrepancies with the staff who issued the food and beverages. All complaints and claims regarding the quality of the food and beverages shall be made directly to the entity producing the food and beverages.
The customer may cancel the food and beverages ordered up to 3 minutes after the order has been placed.
The Seller has the right to unilaterally amend and supplement these Terms and Conditions at any time without prior notice, and the Buyer must therefore read and acknowledge the Terms and Conditions each time before using the food and beverage ordering service. If the Customer has confirmed the order, the Customer shall be deemed to have unconditionally accepted all the Food and Beverage Ordering Rules. The Seller accepts no risk and assumes no liability if the Buyer has placed an order without having read these Terms and Conditions or any part thereof.
Customer Data Privacy Policy of Kitokia Virtuve Ltd.
This policy applies to all personal data that you provide to us, or that we collect and process, when you use your account at www.cafemontmartre.lt.
Kitokia Virtuve Ltd respects your privacy and protects the personal data that you provide to us and that we collect as set out in this privacy policy. This privacy policy explains why we collect your personal data and how we use it.


1. Orders on www.cafemontmartre.lt
When you place an order for takeaway food, you provide your personal data necessary for the acceptance and execution of the order. This is so that we can identify you when you collect your order or contact you in the event of a problem with the order. This data is displayed in your account. They are not collected by other systems and are not used for marketing purposes unless you expressly request it.


2. Direct marketing
We only use and process your data for the purpose of direct marketing if you have given your consent to this. You can confirm your consent to receive direct marketing offers that are useful to you by completing a form.
You have the right to withdraw your consent at any time by contacting us at bonjour@cafemontmartre.lt.


3. Games and lotteries
On the basis of your consent, in order to organise games and lotteries and to notify you of your winnings, we process the names, surnames, telephone numbers and e-mail addresses of the persons participating in lotteries. We process this personal data on the basis of your consent. If you do not provide this personal data, Kitokia Virtuve Ltd. will not be able to ensure your participation in games and lotteries.


4. Data retention period
We process and store all your personal data for no longer than is necessary for the purposes set out in this policy.
For games and lotteries, we will keep your data for no longer than 2 years.
For direct marketing, we process and store data for 2 years after your last visit, unless you withdraw your consent earlier.


5. Data protection
We apply the security and processing requirements set out in the Law on the Legal Protection of Personal Data of the Republic of Lithuania and the EU General Data Protection Regulation to the processing of data.
We take appropriate technical and organisational measures to ensure the protection of all data against accidental or unlawful destruction or accidental loss, alteration, unauthorised disclosure or access, and against all other forms of unlawful processing.


6. Your consents and rights
You have the right at any time, by contacting us at bonjour@cafemontmartre.lt or by post at Didžioji g. 40, LT-01127 Vilnius, to have access to the card data and other personal data processed by us and how they are processed, to request the correction of any incorrect, incomplete or inaccurate personal data, to request the cessation of the processing of your personal data, except for the storage of your personal data, where the data is processed in a manner that is not in accordance with the law and with the terms and conditions of this Policy, and to obtain your personal data in a format that is structured, commonly used, and computer readable (the right of data portability). If you believe that your personal data is being processed unlawfully, you have the right to lodge a complaint with the State Data Protection Inspectorate (A. Juozapavičiaus g. 6, 09310 Vilnius, tel. (8 5) 271 2804, 279 1445, e-mail ada@ada.lt).
In the event that your personal data is processed on the basis of consent, you have the right to withdraw your consent at any time, without affecting the lawfulness of the processing of data based on consent prior to the withdrawal of consent.


7. Validity and amendments
This Privacy Policy is effective from 01 October 2021. If we change this privacy policy, we will post an updated version on our website www.cafemontmartre.lt
